New Jalpaiguri PS Case No. 553/24 dt. 08.06.24 u/s 20(b)(ii)(C) of NDPS Act . (.) Started over the written complaint of the complainant SI Binup Mahato of NJP PS , Siliguri Police Commissionerate lodged complaint against namely Bhushan Kumar (33) S/o Lt. Malpu Ray of Arara, W.No. 3 PO Dharhara PS Hajipur Dist. Vaishali, Bihar to the effect that on 08.06.24 at about 14-10 hrs he received a secret source of information that one Pickup recovery van was coming from Jalpaiguri side towards Bihar through Siliguri with strong reason to believe that the said vehicle was carrying huge quantity of Ganja for clandestinely dispose of the same illegally. Accordingly as per direction of O.C. PS he alongwith other officers and force with mobile Van officer SI Ganesh Roy and force and one videographer left for the spot to verify the veracity of the information vide corresponding NJP PS G.D.E. No. 415 dtd 08.06.24 and NJP PS M.C.C No- 179/23 Dt.08.06.24. On arrival at about 14-55 hrs at Kawakhali near Biswa Bangla Shilpi Hat under NJP PS by Govt. vehicle bearing No. WB-72-B-0007 and starting Spl. Naka checking duty and on identified by the source, they detained one vehicle having No. AS-01-ML-5156 and apprehended driver Bhushan Kumar (33) S/o Lt. Malpu Ray of Arara, W.No. 3 PO Dharhara PS Hajipur Dist. Vaishali, Bihar who was found inside the vehicle in driving seat at on AH-02 , Kawakhali near Biswa Bangla Shilpi Hat under New Jalpaigur PS. After maintaining all formilities he informed Sri Moksedur Rahaman ,ACP, ICP Fulbari, SPC over mobile phone and requested him to come to the spot. At about 15-45 hrs Sri Moksedur Rahaman ,ACP, ICP Fulbari, SPC and O.C. NJP PS arrived at the spot and under the supervision of Sri Moksedur Rahaman ,ACP, ICP Fulbari, SPC and in presence of independent witnesses the complainant conducted search with help of accompanied force and recovered and seized total 08 ( eight ) packets said to be Ganja wrapped with Brown color papers tied with cello tape (1) 12.260 kgs (2) 12.200 kgs (3) 13.100 kgs (4) 12.200 kgs (5) 10.400 kgs (6) 12.200 kgs (7) 12.200 kgs (8) 12.200 kgs ( Total said to ganja weighted 96.760 Kilograme) which was hidden under the said vehicle No. AS-01-ML-5156 and also seized 9. One recovery van (TATA Pickup), white colour having No. AS-01-ML-5156 and 10. One Android mobile phone model “Redmi” Sim No. 7050175401, IMEI No. 862123062879728/ 862123062879736 from the possession of accused person Bhushan Kumar under proper seizure list. On demand in presence of the Gazetted Officer Sri Moksedur Rahaman ,ACP, ICP Fulbari, SPC the apprehended person failed to produce any valid documents in support of possessing the same. On further asked the apprehend person confessed his guilt in presence of Gazetted Officer Sri Moksedur Rahaman ,ACP, ICP Fulbari, SPC and other witnesses that he procured the Ganja clandestinely from Assam side for the purpose of selling the same to his designated customers in Siliguri and adjacent area in order to earn huge money illegally. As such the complainant arrested the above noted accused person u/s- 41 CrPC as the accused person violated the terms and condition of NDPS Act.
