New Jalpaiguri PS Case No. 78/2024 Dtd. 06.02.2024 U/S 21(c) of N.D.P.S Act .Complainant : SI Binup Mahato ( 9800151346) of NJP PS , Siliguri Police Commissionerate .PO :- I.O.C. More under NJP PS, Dist. Jalpaiguri.DO :- On 06.02.2024 in between 11.35 hrs to 14-15 hrs.Started over the written complaint of SI Binup Mahato of NJP PS , Siliguri Police Commissionerate lodged a written complaint against two accused person namely (1) Ranjeet Chhetri (28) S/O- Sontosh Chhetri of Jhankar More, Nepali Busty, W.No.7 PS Siliguri Dist. Darjeeling and (2) Matiur resided at Jhankar More , Siliguri to the effect that on 06.02.24 at about 11.35 hrs the complainant received a secret source of information that one person was standing near I.O.C. More under NJP PS with huge quantity of brown sugar for clandestinely disposal of the same illegally. Accordingly the complainant informed the matter to the duty officer and O.C PS which was diarized vide NJP PS GDE No- 323 dt- 06.02.24. Thereafter as per his instruction he along with other officers and force with mobile Van left for the spot to verify the veracity of the information vide corresponding NJP PS G.D.E. No. 324 dtd 06.02.24 and NJP PS M.C.C No- 127/24 Dt.06.02.24. On arrival at about 12.05 hrs at I.O.C. More under NJP PS by Govt. vehicle bearing No. WB-77-4092, they found one person standing there in a suspicious manner and on being identified by the source they apprehend him in presence of two independent witnesses namely (1) Abdul Rahaman (38) S/O Md Mumtaj of Jalpaimore Natunpara, W.No. 5 PS Siliguri Dist. Darjeeling and (2) Brojokanta Roy (29) S/O-Nalini Roy of NJP Janatapara , W.No. 35 PS NJP Dist. Jalpaiguri and informed them about the information in hand and requested them to accompany them as witness at the time of search and seizure if necessary. On being asked , the apprehended person disclosed his name and identity as noted above which is not verified as on spot he could not produce any documents in support of his identity. After disclosing identity, the complainant asked him whether he wanted to be searched himself in presence of an Executive Magistrate or any Gazetted Officer as he have information he was carrying huge quantities of drugs like brown sugar and he agreed to search by any one. I also served him an option of notice in accordance with the provisions of law in this regard in writing and he also gave his approval of being searched by any one in writing in the notice served to him. Accordingly I informed the matter to O.C. NJP PS and as per his instruction the complainant informed to Sri Moksedur Rahaman ,ACP, East, SPC and requested him to come to the spot through one special messenger namely C/152 Abdul kayum Miah at his office at Teenbatti More, Siliguri. At about 12.45 hrs Sri Moksedur Rahaman ,ACP, East, SPC and O.C. NJP PS arrived at the spot and under the supervision of Sri Moksedur Rahaman ,ACP, East, SPC and in presence of independent witnesses the complainant conducted searched and recovered one thin plastic packet in contents said to be brown sugar wrapped with black colour plastic packet which he was carrying in left side pocket of his Jacket . On demand in presence of the Gazetted Officer Sri Moksedur Rahaman ,ACP, East, SPC the apprehended person failed to produce any valid documents in support of possessing the same. Accordingly the complainant wighed the recovered said to be brown sugar (Heroin) by the weighing instrument and seized (i) One transparent plastic packet in containing 294 grams (Two hundred and ninety four) said to be brown sugar ( Heroin) , Marked as Exhibit- A which recovered from the possession of accused person Ranjeet Chhetri ( from which taken 10 grams as sample) (ii) One transparent plastic packet in containing 10 grams said to be brown sugar ( Heroin) Marked as Exhibit – A1 which taken out from mother packet i.e. SL. No. 1 as sample and (iii) One key pad mobile phone model “itel” blue colour, having IMEI No-(i) 359561143316741 (ii) 359561143316758, Sim No. 8092899518, marked as Exhibit-C from the exclusive possession of the apprehended person under proper seizure list and labeled and sealed all the articles in presence of Sri Moksedur Rahaman ,ACP, East, SPC and independent witnesses and accused person duly signed by them. On further asked the apprehend person confessed his guilt in presence of Gazetted Officer Sri Moksedur Rahaman ,ACP, East, SPC and other witnesses that he procured brown sugar clandestinely from Kaliachak, Malda on behalf of one Matiur resided at Jhankar More , Siliguri who distributed the substance to different seller including him for the purpose of selling the same to their designated customers in order to earn huge money illegally. As such the complainant arrested the accused person Ranjeet Chhetri (28) S/O- Sontosh Chhetri of Jhankar More, Nepali Busty, W.No.7 PS Siliguri Dist. Darjeeling u/s- 41 CrPC as the accused person violated the terms and condition of NDPS Act. The seizure and arrest was made between 13-35 hrs to 14-15 hrs (.) I.O- SI Tanmay Kundu , NJP PS (.)
