Matigara PS case No.1086/2020, dated-22/10/2020 U/S 17(C)/23( C) NDPS Act-:- Started over the written complainant of ASI Binod Jha of Matigara Police Station, Siliguri Police Commissionerate lodged a written complaint against (i) Ohedur Sk(22), s/o- Jamul Sk of Kishmatpur, PO- Srirampur, PS- Kaliachak, Dist- Malda ,(ii) Ruhul Sk (43), s/o- Lt. Kalimuddin Sk of Shersahi pur, PO-Shersahi,Maheshpur, PS- Kaliachak, Dist- Malda , (iii) Md. Mobarak(21), s/o- Md. Babar Sk of Korari Chandpur, PS- Kaliachak, Dist- Malda, (iv) Md. Aktarul Moumin (19),s/o- Alam Moumin of Bhagalpur, PO- Jadupur, PS- Kaliachak, Dist- Malda, (v) Masidur Moumin (25), s/o- Abul Moumin of Bhagalpur, PO- Jadupur, PS- Kaliachak, Dist- Malda, (vi) Subodh Roy(65), s/o- Lt. Rabindra Nath Roy of Baghajatin Colony,Ward no- 45, PS- Pradhannagar, Dist- Darjeeling and (vii) Pritam Kumar Roy @ Banty (30), s/o- Subodh Roy of Baghajatin Colony,Ward no- 45, PO + PS- Pradhannagar, Dist- Darjeeling to the effect that today on 22.10.2020 at about 12.35 hrs. he received a specific source input that five persons are coming from Bagdogra side on a white colour Xylo vehicle bearing no- WB- 60 R-9285 and they are carrying huge consignment of brown Sugar for delivering the same to their designed customers at by lane road of railway fly over ,at Phansidewa more under PS- Matigara who are waiting in a Blue colour Chevrolet Beat LT vehicle bearing registration no- WB- 74 U-9097 . The matter was diarized and informed Officer-In- Charge, Matigara Police Station (.) As per his kind direction he along with officers and force left for railway fly over ,at Phansidewa more under PS- Matigara by govt. vehicle to verify the veracity of the information . At the time of departure from PS he took all necessary investigation kit & other articles . At about 13:05 hrs they arrived at, Phansidewa more near under pass PS- Matigara and called two independent witnesses namely (a) Rishikesh Ghosh, and (b)Manish Daluja, and informed them about the information in hand and requested them to accompany us in the whole process of search and seizure, if necessary After a while as indicated by the source they detained one Xylo vehicle bearing no- WB- 60 R-9285 and vehicle bearing no- WB- 74 U-9097 and also detained the above noted all seven persons who were inside the vehicles including drivers with a strong reason to believe that they have illegally possessed brown Sugar in their possession which they carrying for selling the same to their designed customers for their wrongful gain. On being asked they disclosed their identity as noted above. On being asked the accused persons SL No- i to v admitted that they procured brown Sugar in their possession as per requirement of accused sl no- vi & vii from elsewhere of Kaliachak, Murshidabad ,. Then they are given option either they wanted to be searched in presence of an Executive Magistrate or any Gazetted Officer. Then they agreed to be searched by any one of them. Accordingly, he informed the matter to O/C Matigara PS and as per his kind order he informed to Sri Pasang Topgay Bhutia , ACP Traffic,West, SPC who has been detailed as Special Executive Magistrate of SPC and requested him to come at railway fly over , Accordingly at 14:05 hrs Sri Pasang Topgay Bhutia , ACP Traffic, West, SPC arrived at the spot and in presence of two independent public witnesses searched the detained persons and recovered one transparent plastic packet containing appears to be brown sugar kept inside a blue colour school bag which was carried by them in their possession. On demand in presence of the Gazetted Officer Sri Pasang Topgay Bhutia , ACP Traffic,West, SPC they failed to produce any valid document in support of possessing of the brown sugar which they were carrying. Accordingly weighted the recovered packet by the weighing instrument and found total 2000 grams of appears to be brown sugar from its pasture and smell in a transparent plastic packet which was recovered from the hand bag and marked as Exhibit- “A”. I also taken 20 grams of appear to be Brown Sugar from the said packet in a transparent pouch as sample and marked as exhibit “A-1” he also seized two mobile phones from the possession of accused sl no- iii & vi amd marked as exhibit “E” & “F” respectively. There after ASI Binod Jha arrested them as per arrest rules (.)P.O- Phansidewa More Near under Pass P.S-Matigara , Dist.-Darjeeling (.)
