Matigara PS case No.1039/2020, dated-03/10/2020 u/s 17(b) NDPS Act : Started on the basis of written complaint of ASI Binod Jha of Matigara Police station, Siliguri Police Commissionerate lodged written complaint to the effect that on 03.10.2020 at about 05.05 hrs. he received a specific source input that two young boys are coming from Bagdogra side on a scooty bearing no- WB- 74BB- 5253 who were carrying huge consignment of brown Sugar for selling the same to their designed customers (.)Accordingly, he informed the matter to O/C, Matigara Police Station. As per his kind direction he along with force left for Matigara bazar by govt. vehicle to verify the veracity of the information (.)At the time of departure from office he took all necessary articles and called two independent witnesses and informed them about the information. Then they started waiting for the scooty . After a while as indicated by the source they intercepted the said vehicles along with two young boys who are disclosed their identity as (i) Md. Sakir Alam(19), s/o- Md. Jamaluddin of Nalbari Dangapara, PO- Dimpty, PS- Islampur, Dist- Uttar Dinajpur and (ii) Md. Akter Ali(26), s/o- Md. Kashim Ali of Biswas Colony, Matigara, PS- Matigara, Dist- Darjeeling. They detained the above noted persons with strong reason to believe that they are illegally possessing brown Sugar.. On being asked they confessed that they have possessed brown Sugar in their possession(.) Complainant ASI Binod Jha gave them option in writing whether they wanted to be searched in presence of Executive Magistrate or by any Gazetted Officer. Then they agreed to be searched by one of them (.) Accordingly informed the matter to O/C Matigara PS and as per his kind order Complainant informed Sri Kokil Chandra Roy, ACP ICP, Fulbari, Siliguri Police Commissionerate today who was detailed as Special Executive Magistrate of Siliguri Police Commissionerate regarding the interception (.)At 06:15 hrs Sri Kokil Chandra Roy, ACP ICP Fulbari, SPC detailed as Special Executive Magistrate and in presence of two independent public witnesses searched the detained persons following all formalities and recovered one transparent plastic pouch containing 100 grams said to be Heroin locally called brown Sugar from the right side pocket of pant of the accused Md. Akter Ali which they were carrying. (.)Accordingly weighted the recovered packet by the weighing instrument and found total 100 grams of said to be brown sugar in the transparent packet which was recovered from the pocket of accused Md. Akter Ali (.)Then he seized the above noted articles under proper seizure list and label duly signed by witnesses and the Gazetted Officer and acknowledged by the accused persons (.) . Then arrested the above noted accused persons for violation the terms and condition of Narcotic Drugs for possessing said to be brown sugar without any valid authority & license.
