Bagdogra PS Case No. 313/2025 Dtd. 17/08/2025 U/S- 20(b) (ii) (C)/25/29 of NDPS Act -: Started over the written complaint of SI BinupMahato of Bagdogra PS, SPC alleging against five arrested accused persons namely Bikash Barman, aged 38 years, s/o-Manteshwar Barman, resident of Golenaohati, PO- Golenaohati, PS- Sitalkuchi, Dist- Cooch Behar, (ii) JaminurMiah, aged 25 years, s'o- Massor Ali, resident of Nagar Nepra, PO- Golenaohati, PS- Sitalkuchi, Dist- Cooch Behar, (iii) Anil Namadas, aged 45 years, s/o- RabindraNamadas, resident of ChotoSalbari, PO- Bhawairthana, PS- Sitalkuchi, Dist- Cooch Behar, (iv) Moslem Miya, aged 28 years, s'o- HafijulMiya, resident of Vill& PO- MaddhayamMadhusudan, PS-Sitalkuchi, Dist- Cooch Behar, and (v) Krishno Kamal Barman Ajay Barman, aged 28 years, s/o- Narayan Chandra Barman, resident of Golenaohati, PO-Golenaohati, PS- Sitalkuchi, Dist-Cooch Behar to the effect that today on 17.08.2025 he received a specific source input that some suspects driving in two white colour four wheelers displaying Registration No WB74R/7466 & WB70M/9209 will be proceeding towards Malda side through NH-31 and they have possessed & carried substance suspected to be Ganja for delivering the same to their designed customers. Accordingly he informed the matter to the O/C PS, and as per his kind direction he along with other officers and force left for NH-31 (Kolkata Road) under Bagdogra PS to verify the veracity of the information in hand vide . He also contacted with QRT-36 mobile van Officer and force and also contacted with the videographer to accompany us at the Service Road of NH-31 (Kolkata Road) to prepare the audio-video record of the whole process of search and seizure, if any and he also accompanied them. Further, he also contacted with two independent witnesses namely AkashNagasia, aged 33 years, s/o- Late JitenNagasia, resident of Gangaram TE, Khutipara Line, PS- Bagdogra, Dist- Darjeeling (Ph. No. 9064495462) and Chandan Das, aged 29 years, s/o- Mino Das, resident of Mooni TE, Office Line, PS- Bagdogra, Dist- Darjeeling (Ph. No. 9775510226) and issued them notice in writing to remain present with them as independent witness for the purpose of search, seizure, arrest, if any. On arrival at the NH-31 (Kolkata Road side) at Mooni TE and they made an ambush there. After a lapse of time, source informed that the involved vehicles were coming and they managed to detained above noted two white colour vehicles displaying No. WB70M/9209 &WB74R/7466 and the source identified the suspects. There were two persons inside vehicle No. WB70M/9209 and three persons were inside vehicle No. WB74R/7466. On being asked they revealed their identity as noted above. Then he contacted with ShriDebasish Bose, ACP, DD, SPC holding additional charge of ACP, West Zone-II, SPC regarding the apprehension of said five suspects to be possessed with Ganja including two four-wheelers and sent a requisition requesting him to be present at the spot to supervise the process of search, seizure & arrest (if any) as a Special Executive Magistrate. On arrival of ShriDebasish Bose at the spot and in presence of him and two independent witnesses he searched the detained persons. On search, (i) three packets were recovered from the dickey of Maruti Suzuki XL-6 vehicle displaying No. WB70M/9209, (ii) four packets were recovered from the dickey of Maruti Suzuki XL-6 vehicle displaying No. WB74R/7466, (iii) one realme C21Y android mobile phone is recovered from the possession of Bikash Barman, (iv) one OPPO F19 Pro android mobile phone is recovered from the possession of JaminurMiah, (v) one Vivo Y300 5G android mobile phone is recovered from the possession of Anil Namadas, (vi) one OPPO F17 Pro android mobile phone is recovered from the possession of Moslem Miya and (vii) one motorola edge 50 pro android mobile phone is recovered from the possession of Krishno Kamal Barman @ Ajay Barman. They all identified the packets contains substance as "Ganja". Then he opened the packet and found substance suspected to be Ganja. On demand in presence of the Special Executive Magistrate as well as the independent witnesses they failed to produce any valid document/license in support of possessing of that substance suspected to be Ganja which they had carried. Thereafter, he arranged to weigh the recovered packets contains substance suspected to be Ganja in presence of the Special Executive Magistrate and the independent witnesses with the weighing instrument and found measuring weight 7.660 KG, 7.310 KG, 7.250 KG, 7.265 KG, 8.295 KG, 8.360 KG & 8.280 KG respectively. On further interrogation, they confessed that they have procured those all packets suspected to be Ganja clandestinely from Sitalkuchi in Cooch Behar district and had been proceeding to Kishanganj driving on their two four-wheelers there for the clandestine disposal of the consignment for their wrongful gain. On interrogation they also disclosed that they have been dealing in such business of selling Ganja illegally for a long time. There after he seized the above noted recovered articles from their joint possession at the spot under proper seizure list in presence of the Special Executive Magistrate as well as the independent witnesses as noted above and acknowledged by the accused persons and arrested them after observing all legal formalities and communicating them the ground of arrest in writing . The entire process of search, seizure & arrest was made in between 11.37hrs and 13:15 hrs on 17.08 2025. (total weight 54.420 KG)(.)
