Bagdogra PS Case No. 90/2025 Dt.17.03.25 U/S- 21(c) of NDPS Act: Started over the written complaint of SI Debabrata Kundu of Bagdoga PS, SPC alleginng against one arrested accused person namely Chaman Ali @ Chiku, aged 33 years, s/o-Late Daribuddin Darab, resident of Budhugachh, Kuchila, Ramganj, PS- Islampur, Dist- Uttar Dinajpur to the effect that today on 17.03.25 he received a specific source input that one suspect had been waiting at Kolkata Road (NH-31) and he had possessed & carried substance suspected to be brown sugar for delivering the same to his designed customers. Accordingly he informed the matter to the O/C PS and as per his kind direction he along with other officers and force left for Kolkata Road (NH-31) under Bagdogra PS to verify the veracity of the information and also contacted the videographer namely Nikhil Sarkar and two local witnesses to accompany them at Kolkata Road (NH-31) to prepare the audio-video record of the whole process of search and seizure, if any and issued them notice in writing to remain present with them as independent witness for the purpose of search, seizure, arrest, if any. They expressed their willingness to remain present with us as independent witness. On arrival at Kolkata Road (NH-31) near Track Marshal they made an ambush there and after a while as source informed that the suspect had been waiting on the service road of NH-31, Kolkata Road near Track Marshal. After reaching to the place they cordoned the place from all directions and being indication by source they apprehended the above noted person on. Then after disclosing their identity, they detained the suspect with a strong reason to believe that he was illegally possessing, carrying and dealing with Brown Sugar in his exclusive possession for selling the same to his designed customers for his wrongful gain. On being asked he revealed his identity as noted above and confessed his guilt and admitted that he possessed Brown Sugar and had been waiting there for delivering the same to his designed customers. Thereafter maintaining all the formalities and after arrival of Shri Debasish Bose, ACP, West-II, SPC as a Special Executive Magistrate to supervise the process of search & seizure, in presence of him and independent witnesses the detained person was searched and he recovered one black colour plastic carry bag concealed inside his wearing apparel (shirt). On opening the black colour plastic carry bag, five plastic pouches containing brown colour powder like substance suspected to be "brown sugar" were recovered. Further, one mobile phone (Vivo Y16), one brown colour leather purse, EPIC and Cash Rs. 940/- were also recovered from his possession.On demand in presence of the Special Executive Magistrate and the independent witnesses he failed to produce any valid document in support of possessing of that substance suspected to be brown sugar which he had carried. On weighing it is found measuring 102, 103, 103, 97 & 102 grams including plastic pouches respectively. On further interrogation, he confessed that he procured the brown sugar clandestinely from Ramganj, Islampur for the purpose of delivery the same to his designed customers at Bagdogra and Siliguri area as per his requirement for his personal gain by illegal means. On interrogation he also disclosed that he has been dealing in such business of selling brown sugar illegally for a long time. Thus when his involvement in carrying, possessing and dealing with brown sugar was established. Accordingly the complainant seized the above noted recovered articles from his exclusive possession at the spot under proper seizure list in presence of the Special Executive Magistrate as well as the independent witnesses and arrested him. The process of search, seizure & arrest was made in between 18:37 hrs and 19:48 hrs on 17.03.2025. The process of search, seizure & arrest is done through audio-video electronic means using DSLR camera and then the same audio-video record is converted to a pen drive using computer system.(.)
