Bagdogra PS Case No. 63/2025 Dt.02.03.25 U/S-21(c)/23(c)/29 of NDPS Act: Started over the written complaint of one SI Debabrata Kundu of Bagdogra PS, SPC alleging against two arrested accused persons namely (i) Abhi Sherpa @ Amush, aged 25 years, s/o- Gagan Sherpa, resident of Shalugara, Demdema Basti- Bhaktinagar, Dist.- Jalpaiguri and (ii)Kari Paswan, aged 34 years, s/o- Ramprakash Paswan, resident of Shalugarn, Demdema Basti-Bhaktinagar, Dist.- Jalpaiguri to the effect that today on 02.03.25 he received a specific source input that two suspects had been coming from Dalkhola side through NH-31 and they will proceed to Siliguri side riding on a motorcycle possessing & carrying suspected to be brown sugar for delivering the same to their designed customers. Accordingly, he informed the matter to O/C Bagdogra Police Station and as per his kind direction a raiding team was and they left for Kolkata Road (NH-31) near Diamond Crown Township under Bagdogra PS to verify the veracity of the information and also contacted with the videographer namely Nikhil Sarkar to accompany them at Kolkata Road (NH-31) to prepare the audio-video record of the whole process of search and seizure, if any. Further, he also contacted with two local witnesses namely Md. Ruhan and Md. Kader, for the purpose of search, seizure, arrest, if any. At around 11:45 hrs they reached at Kolkata Road (NH-31) near Diamond Crown Township and made an ambush there. After a while, the source indicated that the suspects were approaching towards Bagdogra side from Ghospukur side through NH-31 riding on a gray colour Royal Enfield motorcycle. At around 11:57 hrs they detained the said gray colour Royal Enfield Classic 350 motorcycle displaying Registration No. WB74BA/1040 with a strong reason to believe that they were illegally possessing, carrying and dealing with Brown Sugar in their joint possession for selling the same to their designed customers for their wrongful gain. On being asked they revealed their identity as noted above. At last, they confessed their guilt and admitted that they possessed Brown Sugar in their joint possession and had been proceeding towards Shalugara for delivering the same to their designed customers. Thereafter in presence of Magistrate or Gazetted Officer namely Shri Debasish Bose, ACP, West-II, S.P.C and two independent witnesses he searched the detained persons including their motorcycle following all legal formalities and recovered one olive green colour side bag styled as "Tenzing made in India" which was kept concealed inside the wearing apparels of the suspect Abhi Sherpa @ Amush. On search, two plastic pouches contains brown colour substance suspected to be "brown sugar" were recovered from the said side bag possessed by Abhi Sherpa @ Amush. Further two mobile phones ie. one MTR BHARAT keypad mobile phone & one Vivo Y33S android mobile phone were also recovered from the possession of the suspect Abhi Sherpa @ Amush. Then he searched the suspect Kari Paswan and found one plastic pouch contain brown colour substance suspected to be "brown sugar" was from the left pocket. They both identified the substance as "Brown Sugar". On demand in presence of the Special Executive Magistrate and the independent witnesses they failed to produce any valid document in support of possessing of that substance suspected to be brown sugar which they were carrying using that motorcycle. On weighing total -304 gram (measuring 100 grams, 102 grams & 102 grams including plastic pouches) suspected to be brown sugar recovered. On further interrogation, they confessed that they procured the brown sugar clandestinely from Dalkhola for the purpose of delivery the same to their designed customers at Shalugara and Champasari area as per their requirement for their personal gain by illegal means. Thereafter, he seized the above noted articles including the gray colour Royal Enfield Classic 350 motorcycle displaying Registranon No. WB74BA/1040 having Chassis No. MEJU355C2KK720472 along with its ignition key from the exclusive joint possession of the above noted accused persons at the spot under proper seizure list in presence of the Special Executive Magistrate as well as the independent witnesses as noted above and arrested them after observing all legal formalities as well as after communicating them the ground of arrest in writing as they have committed a cognizable offence in presence of Police Officers for possessing & carrying substance suspected to be brown sugar and issued memo of arrest in this regard. The process of search, seizure & arrest was made in between 11:57 hrs and 13:19 hrs on 02.03.2025. The process of search, seizure & arrest is done through audio-video electronic means using DSLR camera and then the same audio-video record is converted to a pen drive using computer system (.)
