New Jalpaiguri PS Case No. 1085/24 dt. 23.10.24 u/s 20(b)(ii)(c) NDPS Act (.) Started over the written complaint of SI Kalyan Saha (M.No. 8906214793) of NJP PS, Siliguri Police Commissionerate lodged written complaint against Ainul Miah (34) S/o Pirmamud Miah of Gheghirghat, Dewan Hat , PS Kotwali Dist. Coochbehar to the effect that on 23.10.24 at about 12-35 hrs received a specific information provided by a credible source that one Car having regd No. WB-74-R-1262 loaded with huge quantity of Ganja, a contraband Drug under the NDPS Act has been parked at Jotiakali infront of Pradip Dhaba (Ramkrishna Hotel), on NH-31, under NJP PS and informed the information to O.C. PS and duty officer and noted in GD vide New Jalpaiguri PS GDE No. 1260 dated 23.10.24. At 12-45 hrs as per direction of O.C. PS he along with other officers and force left for Pradip Dhaba (Ramkrishna Hotel) from PS to work out the veracity of the information vide NJP PS GDE No-1261 dated-23.10.24 and MCC No-698/24 dated-23.10.24. They arrived at Pradip Dhaba (Ramkrishna Hotel), on NH-31under NJP PS and on identified by the source the complainant detain the Car having regd No. WB-74-R-1262 and apprehended one person who was sitting inside the said vehicle in the driver’s seat. Accordingly he informed the matter to O.C. NJP PS and as per his direction also inform to Sri Somnath Das ,ACP, East-II, SPC as Gazetted Officer as no other magistrate were available in that time. At 14:35 hours Shri Somnath Das, ACP East-II, SPC arrived at the spot and under the supervision of Gazetted officer Sri Somnath Das ,ACP, East-II, SPC the complainant recovered 03 (three) bags containing Ganja from the said vehicle, accordingly the complainant seized the three bags containing (i) 13.895 kg Ganja inside one Blue colour Jute bag styled as Signature finest Pan Masala which was marked as Exhibit- A, (ii) 11.250 kg Ganja inside one Red colour Synthetic bag styled as PARKASH Pulses marked as Exhibit- B and (iii) 11.460 kg Ganja inside Blue colour Synthetic bag styled as AAT, 5 RIVER, Sella basmati rice - Marked as Exhibit –C and the said vehicle No. WB-74-R-1262 , one mobile phone and Driving License of the apprehended person under proper seizure list in presence of witnesses and gazatted officer Shri Somnath Das, ACP East-II, SPC . On demand in presence of the Gazetted officer Sri Somnath Das ,ACP, East-II, SPC the apprehended person failed to produce any valid documents in support of possessing the same. On further asked the apprehend person confessed his guilt in presence of Gazetted Officer and other witnesses and also stated that he procured the said Ganja clandestinely from Cooch Behar for the purpose of selling the same to their designated customers in Siliguri and Bihar in order to earn huge money illegally. As such the complainant arrested the apprehended person namely Ainul Miah (34) S/o Pirmamud Miah of Gheghirghat, Dewan Hat , PS Kotwali Dist. Coochbehar.
