Matigara PS case No. 858/20 dated-16/08/2020, U/S 21(C)/23(C) NDPS Act has been registered over the written complaint of ASI Binod Jha of Matigara PS, SPC lodged a written complainant against (i) Md. Basiruddin @ Basir(40), s/o- Md. Nurul Islam of Patnour, PS- Karandighi, Dist- Uttar Dinajpur a/p Loknath Colony,Baniakhari, PS- Matigara and (ii) Muni Swarnakar (45), w/o- Lt. Bipul Swarnakar of Biswa Colony, PS- Matigara at present kept of Md. Basirul of Loknath Colony, Baniakhari, PS- Matigara to the effect that 16.08.2020 at about 14.15 hrs. ASI Binod Jha received a specific source input that one lady and one male person are coming from Loknath Nagar, Baniakhari in a black and blue colour Super Splendor Motor Cycle and they carry huge consignment of brown Sugar for selling the same to their designed customers for their wrongful gain(.) Accordingly he diarized the matter and informed the matter to the Officer In Charge, Matigara Police Station in writing a letter to him and expressed the entire information (.) As per his kind direction of O/C Matigara PS he along with other officers and force including lady force left for Baniakhari Loknath Colony, Matigara area by govt. vehicle to verify the veracity of the information(,) At about 14:45 hrs we arrived at Loknath Colony, Baniakhari and called two independent witnesses and after disclosed the identity and informed them about the information in hand and requested them to accompany us in the whole process during search and seizure if necessary with a written letter and necessary permission of their presence and as witnesses of entire process under relevant provision of law(.) As identified by the source they found one person and one lady are coming in a Motor Cycle (.) Accordingly police team intercepted the said Motor Cycle and also detains the rider of the Motor Cycle and co rider lady with the help of Lady (.) After disclosing the identity, we detained the above noted person and lady with the help of lady force with a strong reason to believe that they illegally possessing brown Sugar in their possession which they carrying for selling the same to their designed customers for their wrongful gain(.) On being asked they confessed that they have possessed brown Sugar in their possession for selling the same to their designed customers as per requirement (.) Accordingly, complainant informed to Sri Narendra Kalikotey, ACP East-II, SPC today who was detailed as Special Executive Magistrate of SPC regarding the interception of the accused person suspected to be possessed of Brown Sugar and requested him to at Loknath nagar , Matigara to remain present and to supervise the search and seizure being a gazette officer(.) Accordingly at 15:25 hrs Sri Narendra Kalikotey, ACP East-II, SPC arrived at the spot and in presence of two independent public witnesses searched the detained person and the lady (by the lady constable) following all formalities keeping their decency and recovered one transparent plastic pouch containing 285 grams said to be brown sugar from the hand bag which was carry by them in their Motor Cycle (.) On demand in presence of the Gazetted Officer Sri Narendra Kalikotey, ACP East-II, SPC they failed to produce any valid document in support of possessing of the brown sugar which they were carrying.(.)Accordingly weighted the recovered packet by the weighing instrument and found total 285 grams of appears to be brown sugar in a transparent pouch which was recovered from the hand bag also recovered cash Rs 69,000/= from the said bag of different denomination marked as exhibit “B” and 48 pices of transparent pouch and one Black and Blue colour Super Splendor Motor Cycle bearing no- WB-74P- 5665 [.] Then arrested above noted accused persons after observing all guidelines of Apex court (.)
