MATIGARA PS CASE NO-544/20, DATE-10.06.2020,U/S-17(B) NDPS ACT= Started over the written complaint of ASI Binod Jha of Matigara PS, SPC lodged a written complainant against Puspa Begum(30), w/o- Md, Belal of Biswas Colony, PS- Matigara, Dist- Darjeeling to the effect that on 15.07.2020 at about 16:10 hrs. he received a specific source input that one lady is waiting at NBU gate no- 2, PS- Matigara who is carrying huge consignment of brown Sugar for selling the same to her designed customers for her wrongful gain. T . Accordingly he was diarized the information and shared the information O/C Matigara P.S. As per direction of O/C Matigara PS he along with other Officer and force left for NBU Gate no-2, Matigara to verify the veracity of the information. At about 16:35 hrs they arrived at NBU Gate no- 2, and requested two independent witnesses and requested them to remain present during search and seizure. As identified by source he detained above noted lady with strong reason to believe that she have possessing brown Sugar . On being asked she confessed that she has possessed brown Sugar for selling the same to her designed customers. Then ASI Binod Jha was given option in writing either she wanted to be searched by Executive Magistrate or by any Gazetted Officer accordingly she agreed to be searched by one. Thereafter ASI Binod Jha informed the matter to O/C Matigara PS and as per his kind order informed to Sri N.Kalikotay, ACP, East-II, SPC today who was detailed as Special Executive Magistrate and requested him to come NBU Gate no-2, Matigara to remain present and to supervise the search and seizure being a gazette officer. At 17:15 hrs Sri N.Kalikotay, ACP, East-II, SPC turned up the P.O. and in presence of two independent public witnesses searched the detained lady by lady constable and recovered one transparent plastic pouch containing 880 grams said to be brown Sugar from one ladies hand bag of the accused Puspa Begum which she was carrying. Accordingly weighted the recovered packet by the weighing instrument and found total 880 grams from the of said to be brown sugar in the transparent packet and marked as Exhibit- “A” and also taken 10 grams of said to be Brown Sugar from the said packet as sample and marked as exhibit A-1. and also labeled and sealed all the articles in presence of the Sri N.Kalikotay, ACP, East-II, SPC, and independent witnesses. The seizure was made between 17:25 hrs to 18:15 hrs. Then arrested above noted accused person after observing all guidelines of Apex court. I.O SI BASUDEB GUHA (.)
